Open Letter to UN Secretary-General Kofi Annan Calling for United Nations Intervention on Behalf of Mumia Abu-Jamal 

Dear supporters of the international campaign to free Mumia Abu-Jamal:

On August 29th, the following Open Letter was delivered in Durban, South Africa, to senior representatives of UN Secretary-General Kofi Annan, who assured the delegation that the letter would be delivered directly to Mr. Annan. The Open Letter calls for United Nations intervention on behalf of Mumia Abu-Jamal, who has been on death row in the United States for 20 years.

The Open Letter was delivered at the UN headquarters in Durban by a delegation mandated by the Independent Workers Conference, held earlier that day in Durban at the initiative of the International Liaison Committee and the Permanent Committee of the International Tribunal on Africa. The delegation also delivered two other texts: (1) the Final Declaration adopted by the August 29th Independent Workers Conference, and (2) a separate Open Letter to Kofi Annan on the other central issues addressed by the August 29th conference: cancellation of the debt, reparations, end to the IMF/World Bank Structural Adjustment Plans, etc. [See previous OWC posting with the text of this first Open Letter.]

The delegation was accompanied by a demonstration convened by the organizers of the August 29th conference. Lybon Mabasa, president of the Socialist Party of Azania, addressed the rally -- which was held in the presence of the UN officials. He presented to the UN representatives and to the rally participants the conclusions of the Conference and read the Final Declaration adopted by that gathering. The UN campaign to free Mumia -- whose ultimate aim is to obtain a UN Resolution calling for freedom for Mumia -- was initiated by the International Tribunal on Mumia. Supporters of the campaign include the International Concerned Family and Friends of Mumia Abu-Jamal, the International Committee to Save the Life of Mumia Abu-Jamal, the Mobilization to Free Mumia and many others -- including the OWC Continuations Committee.

The Open Letter was drafted by a Sub-Committee of the National Coordinators of the Mumia defense campaign. Members of the UN Campaign Sub-Committee that drafted this Open Letter are Sam Jordan, Pam Africa, Suzanne Ross, Jeff Mackler, Julia Wright and Alan Benjamin. Sam Jordan, the lead author of this Open Letter, participated in the August 29th Conference in Durban, which mandated the delegation that delivered the Open Letter to representatives of Kofi Annan.

Greetings, Mr. General Secretary:

The United Nations has affirmed in its proceedings, conventions and covenants and reports a policy of opposition to all forms of racism and racial discrimination. The third World Conference Against All Forms of Racism, Racial Discrimination, Xenophobia and Related Intolerance (WCAR) scheduled for August 31 - September 7, 2001, promises to focus the world's attention again on the eradicable scourge of racism.

In Philadelphia in 1997, the International Tribunal for Justice for Mumia Abu-Jamal, an assembly of jurists, rapporteurs and witnesses, was convened to examine the case of Mumia Abu-Jamal. The Tribunal found that in its course through the criminal justice system, Abu-Jamal's case was characterized by egregious violations of his civil and human rights as provided in the U.S. Constitution and the International Covenant on Civil and Political Rights, respectively. The Tribunal concluded without qualification that the criminal justice system in the United States of America has wrongfully convicted Mumia Abu-Jamal.

No corroborating evidence whatsoever has been adduced by prosecutors linking Mr. Abu-Jamal to the crime with which he has been charged, the murder of a police officer. Chief prosecution witnesses have recanted their original testimonies that were offered under duress. Evidence serving to impeach testimony regarding a "confession" by Mr. Abu-Jamal was obstructed by prosecutors and never presented to the trial jury.

Prosecutors have deliberately withheld additional exculpatory evidence including ballistics tests and statements of eyewitnesses. Mr. Abu-Jamal's membership as a youth in the Black Panther Party was cited by prosecutors as justification for the imposition of the death penalty in full contravention of U.S. Constitutional guarantees to freedom of speech and association.

Moreover, testimony before the Tribunal established that the case of Mumia Abu-Jamal represented at least four major currents of racist policies affecting the criminal justice system in the U.S.: (a) Police brutality and racial profiling; (b) Disproportionate imposition of the death penalty on the poor and people of color; (c) Accelerated rates and extended duration of incarceration of African-Americans in the U.S. prison system; (d) Criminalization of the work and ideas of political dissidents rendering them political prisoners - most often African-Americans and other people of color.

The implementation of each of these policies has occurred in the case of Mumia Abu-Jamal. He was brutally and repeatedly beaten at the hands of Philadelphia police officers at the scene of the crime for which he was wrongfully convicted and again in the hospital where he was transported for treatment of his own serious injuries suffered in the same incident. Abu-Jamal was arbitrarily sentenced to death although neither physical nor forensic evidence linked him to any capital crime. He has been on death row almost twenty-years - longer than the average period of incarceration for those convicted of homicide, while the U.S. prison population has grown to more than two million, an unprecedented total for any nation. Over sixty-percent (60%) of this population is African-American and Latino.

The pursuit of these policies in the U.S. in 2001 has created the same urgent need for action that led the United Nations to issue its initial Declaration on the Elimination of Racism and All Forms of Racial Discrimination in 1963. When the Declaration was issued, the world's focus on racism and its various forms was galvanized by the fight against apartheid in South Africa and the courageous civil rights movement in the U.S. In 1983, the second World Conference Against Racism stated that, "Racism and racial discrimination are continuing scourges, which must be eradicated, throughout the world." It declared that racism and apartheid are "totally abhorrent to the conscience and dignity of mankind," that they are crimes against humanity, and constitute a "threat to international peace and security."

The case of Mumia Abu-Jamal is at once a stunning, potentially fatal example of the impact of racism on a single individual while it is representative of the cases and conditions of untold thousands.

The national and international movements that have grown in support of justice for Mumia Abu-Jamal have met with failure in appeals to all relevant authorities in the U.S. In July 2000, an amicus brief was filed in Mr. Abu-Jamal's case by twenty-two (22) Members of the British Parliament. The brief, a copy of which is appended hereto sets forth twenty-nine (29) instances of violations of Mumia Abu-Jamal's rights as a citizen and defendant. The brief was summarily rejected by the U.S. District Court which retains jurisdiction of Mr. Abu-Jamal's case.

With identical results, two international delegations of jurists, trade unionists and elected representatives from seven nations met with officials of the U.S. Department of Justice in January and December of 2000. The appeals of the delegations went unheeded and were accorded the minimum permissible bureaucratic civility.

Without redress in the U.S., this matter must be brought to the forum of world opinion for timely intervention. It is in the pursuit of such intervention that we appeal to you now, Mr. Secretary-General, for your assistance in marshaling the considerable leverage residing in the United Nations.

We seek passage of a resolution by the United Nations General Assembly demanding justice, the release of Mumia Abu-Jamal. There is no doubt that such a resolution would announce without equivocation that people of conscience throughout the world are alarmed and strongly disapproving of the racist, unjust treatment received by Mumia Abu-Jamal and others similarly situated in the United States of America.

Such a resolution by the United Nations may well be the catalyst for relief long sought by the hundreds of thousands subjected to the grinding racism and inhumanity of the U.S. criminal justice system.

We ask that you receive a delegation of the signatories of this Letter to meet with you prior to the World Conference (WCAAR) in South Africa in order to discuss this matter and to determine the most propitious route to a UN resolution to Free Mumia Abu-Jamal.
